Ushers Needed

Captain Bill Aramony, JAGC, USNR, who is the Coordinator of the Change of Office between RADM Clifford J. Sturek and RADM(S) Steven B. Kantrowitz, has advised that ushers are very much needed for this occasion.  The requested rank is Lieutenant or Lieutenant Commander, and the uniform will be Service Dress White with large medals but no sword.  The Change of Office will take place at 1400 on 6 October 2000 in Leutze Park at the Washington Navy Yard.

AT/ADT/ADSW Opportunity at NTC Great Lakes 

The Staff Judge Advocate, Naval Training Center, Great Lakes, IL has an immediate an ongoing need for Judge Advocates to assist in her office. Work will include standard SJA work for a GCM authority at the largest Naval Training Center in the United States. there are several special projects in addition to the regular SJA work. 

The request is for current AT/ADT plus applications from individuals interested in performing ADSW (179 days) at NTC Great Lakes. LT, LCDR and CDR grade restrictions.

ADSW Opportunity at Roosevelt Roads 

CINCLANTFLT has announced an opportunity for a Naval Reserve Judge Advocate to serve on ADSW in Roosevelt Roads, Puerto Rico. The selectee would serve as a Special Assistant U. S. Attorney (SAUSA) in support of the federal prosecution of a large number of individuals who have been charged with trespassing on a naval installation located on the island of Vieques. 

The ideal candidate will have significant criminal trial experience and excellent writing skills, as the majority of the cases will require litigation of pre-trial motions as well as a multi-defendant criminal trial in U.S. District Court. Spanish language proficiency is helpful but not required, as court proceedings are conducted in English. 

This is an excellent opportunity for a Reserve JA to work with Navy and DOJ attorneys in a high profile and fast paced environment. The period for this ADSW would be for no less than 60 days nor more than 179. There are no grade restrictions for this request.

ADT Opportunity at Code 10, International Law

RADM(Sel.) Kantrowitz has advised of a current ADT opportunity for a Legalman to serve for up to two weeks at OJAG Code 10, International Law, at the Washington Navy Yard.  The point of contract for more information is the Division Director, CAPT(Sel.) ADSW Opportunity at Recruit Training Command, Great Lakes

Recruit Training Command, Great Lakes has an immediate opening for a Chief Legalman or experienced Legalman First Class to work in the Recruit Training Command Legal Office.  The ADSW will commence immediately and last through the end of the fiscal year on 30 September 2000, with the possibility of another period of ADSW following to last until January 2001.  Interested Legalmen should contact LCDR Bob McBride at the Recruit Training Command Legal Office, 847-688-4791.


ADT Opportunity at SACLANT, Norfolk, VA

Captain Frank Prochazka, JAGC, USN, Legal Advisor to the NATO Commander in Norfolk, Virginia (Supreme Allied Commander Atlantic or SACLANT), is requesting one reservist to do a 12 day ADT this summer (exact timing is flexible) at the Headquarters in Norfolk. Requirements are paygrade of Commander or senior LCDR with international or operational law background. All interested officers should contact Captain Peterson. "What's New" Link at OJAG

OJAG Code 62 has announced a new initiative to provide a continuing information resource on the OJAG Home Page to active and reserve members of the Judge Advocate General's Corps and the Legalman rating entitled "What's New."  

The username for publicly available documetns is "public" and the password is "publicdocs".  If you need access to JAG documents, your Staff Judge Advocate should have the username and password.  For security reasons, those cannot be posted here.

ADSW Opportunity at Roosevelt Roads

  The SJA office at CINCLANTFLT has announced an opportunity for a Naval Reserve Judge Advocate to serve on ADSW at its branch office in Roosevelt Roads.  The period would be for no less than 140 days nor more than 179.  There are no grade restrictions for this request.  The principal activity is anticipated to be litigation support, but other command advice opportunities may be available as well.  The ideal candidate will have either litigation experience in cases involving significant documentary evidence or an environmental law background.

This is an excellent opportunity for a Reserve JA to get known throughout the CINCLANTFLT community and to be involved in cutting edge legal issues that are being briefed at the highest levels on a daily basis.  Clarification of Reserve CO NJP Authority

A recent change to the JAGMAN did not specifically include the authority of reserve unit COs to impose NJP upon unit members.  Until the next change to the JAGMAN is issued, the following is the official interpretation from OJAG:

[From LCDR R. Johnson to CDR C. Wells]

This question has come up before. The best we can tell there was an editing problem in change 3 before it was promulgated. The final version of 0106 as was approved for printing included the following final sentence "This authority to impose nonjudicial punishment extends to reserve commanders or commanding officers on active duty or inactive duty training." However, as you have discovered, it does not appear this way in change 3.

It is our opinion that the language in 0106 as it appears in change 3 does not limit the NJP authority of reserve commanders/commanding officers. All commanders and commanding officers per Article 15, UCMJ have the authority to impose NJP unless limited by the President or the Secretary concerned. Neither MCM, Part V nor the JAGMAN have limited the NJP authority of reserve commanders/ commanding officers. Paragraph 0106 in change 3 was being amended, not to limit authority to reserve commanders, but to to make clear that reserve commanders/commanding officers have NJP authority under UCMJ Art. 15. We hope to correct this editing error in the pending change 4 to the JAGMAN.

In the meantime it is our interpretation that if a reserve commander/commanding officer and an accused are both subject to the UCMJ (including inactive duty training status--UCMJ, Art. 2(3)) at the time of the Captain's Mast then the reserve commander/commanding officer can impose NJP.

Navy and Marine Corps Achievement Medals for Recruiting

In a NAVADMIN from BUPERS, a proactive awards program has been announced which authorizes a broad level of awards, up to the Navy and Marine Corps Achievement Medal, for Naval personnel, active or reserve, who recruit a certain number of persons into the Navy which in fact results in enlistment contracts. The award does not seem to be rank sensitive for the medal, which ordinarily is only for 0-4 and below.
